Terms of Service

1. Acceptance

By using DivEscape (“the site,” “we,” “us”), you agree to these Terms of Service. If you do not agree, please do not use the site.

2. What DivEscape is

DivEscape is informational dive trip planning. The site helps you discover destinations, save favorites, compare options, and find dive operators or hotels.

DivEscape does not book trips. All bookings, reservations, payments, refunds, and arrangements are made directly between you and the dive operator, hotel, or travel provider. DivEscape never holds your money, never confirms reservations, and is not a party to any transaction between you and an operator. DivEscape is not a substitute for certified diving instruction or local diving authorities.

3. Accounts

  • You must be at least 16 years old to create an account.
  • You agree to provide accurate information at sign-up and to keep your account information current.
  • You are responsible for keeping your password secure and for any activity that happens under your account.
  • One account per person.

4. Permitted use

You may use DivEscape for personal, non-commercial dive trip planning — including saving destinations, comparing options, and adjusting your preferences.

5. Prohibited use

You may not:

  • Scrape or automate access to the site beyond reasonable manual use.
  • Reverse-engineer, decompile, or attempt to derive the source code.
  • Impersonate another person or misrepresent your identity.
  • Harass, threaten, or harm other users.
  • Post or transmit illegal, harmful, or infringing content.
  • Attempt to circumvent paid-tier gates once paid tiers ship.

6. Third-party content

Destination photos are sourced via Unsplash and shown subject to the Unsplash license. Operator listings in the “Where to dive & stay” block are provided by the operators themselves or compiled from public sources — see Section 10 for the full disclaimer.

7. Operator subscriptions

Operators may purchase a paid subscription (currently the Pinnacle tier) to unlock additional features. Subscriptions recur monthly or annually based on the plan chosen at checkout. Billing is processed through Stripe; you can manage or cancel your subscription at any time via the Stripe Billing Portal, accessible from your operator dashboard. Access to paid features ends when the subscription lapses or is cancelled; no partial-period refunds are issued unless required by applicable law.

DivEscape reserves the right to change subscription pricing with at least 30 days' notice. Continued use after a price change takes effect constitutes acceptance of the new price.

8. User content

When you set a display name, save favorites, or update profile preferences, you grant DivEscape a license to store this data and serve it back to you. We do not make your saved data public; no other user can see what you've saved. You may delete your account at any time to remove this data.

If you hold an operator account, you are responsible for the accuracy of the listing information you submit, and by uploading a hero photo you confirm you hold the rights to use and display that image.

9. Termination

You may delete your account at any time via /account → Danger zone. If you hold an operator subscription that is set to renew, cancel it first via the Stripe Billing Portal — we ask you to cancel before deleting so your account is never billed after it is gone. After deletion, your account enters a 30-day soft-delete window — sign back in within that window to recover the account. After 30 days, all account data is permanently deleted.

DivEscape may suspend or terminate accounts for breach of these Terms (especially Section 5) with reasonable notice.

10. Disclaimers

Data accuracy

Destination profiles, dive sites, marine life sightings, water and air temperatures, depth ranges, season recommendations, and similar information are compiled from public sources and personal research. DivEscape maintains and improves this data over time, but it is best-effort — entries may be incomplete, outdated, or outright wrong at any time, and conditions vary with weather, season, and year. Always verify with current local sources (dive shops, recent trip reports, regional dive authorities, weather and marine forecasts) before planning or booking a trip.

Diving safety

Diving is inherently dangerous. DivEscape is not a substitute for certified diving training, current medical clearance, or in-person briefings from qualified instructors. Live conditions (currents, visibility, marine hazards, water temperature on the day) are the responsibility of certified local operators to assess.

Medical fitness

Diving requires medical clearance from a qualified physician. DivEscape does not assess your fitness to dive, does not collect medical information, and makes no representation about whether any destination is safe for a particular individual. You are responsible for obtaining and maintaining current medical clearance and for following the recommendations of your physician and dive instructor.

Travel advisories & external conditions

DivEscape does not track government travel advisories, visa or vaccination requirements, political situations, civil unrest, pandemics, weather events, or other conditions affecting whether a trip is safe or possible. Always check your government's foreign-ministry travel advisories, consult a travel doctor for vaccinations and prophylaxis, and verify entry requirements with the destination country before booking.

Local laws & marine protection

Diving destinations frequently fall under protected-area regulations, species-protection laws, permit requirements, photography restrictions, anchoring rules, spearfishing prohibitions, or seasonal closures. Some species are illegal to touch, collect, or photograph with flash; some marine parks cap daily visitor numbers; some sites require advance permits. DivEscape does not enumerate these restrictions. You are responsible for knowing and complying with all local laws and regulations at your destination.

Operator listings

Information in the “Where to dive & stay” block — including operator capabilities, courses, prices, and contact details — is provided by the operators themselves or compiled from public sources. DivEscape does not independently verify operator listings; treat them as a starting point, not a recommendation, and confirm details directly with the operator.

Service “as is”

DivEscape is provided “as is” without warranty of any kind, express or implied.

Service availability

DivEscape relies on third-party infrastructure (hosting, database, email delivery). The service may be unavailable from time to time due to maintenance, third-party outages, or events outside our reasonable control. We do not guarantee uptime and are not liable for interruptions.

11. Limitation of liability

To the maximum extent permitted by Swiss law, DivEscape (Rico Hasler) is not liable for indirect, incidental, consequential, or special damages arising from your use of the site — including, without limitation, decisions made in reliance on information shown on the site, injury or harm from diving activities, or losses related to bookings made with third-party operators.

12. Changes to these Terms

Material changes to these Terms will be notified via email (using the same SMTP relay as our auth emails) at least 14 days before they take effect. The “Effective date” at the top of this page reflects the most recent revision.

13. Governing law and jurisdiction

These Terms are governed by Swiss substantive law. The place of jurisdiction for any dispute is Zürich, Switzerland.
